Hawaii Rabbitry Purchase Agreement
This Purchase Agreement ("Agreement") is made and entered into between Hawaii Rabbitry ("Seller") and the Buyer. By paying the deposit required to reserve a bunny, the Buyer acknowledges that they have read, understood, and agree to the following terms and conditions. The Buyer further agrees that payment of the deposit legally binds them to the terms set forth in this Agreement.

1. Deposit and Payment Terms
1.1 A non-refundable deposit of 50% of the total purchase price is required to reserve a bunny.
1.2 The remaining balance must be paid in full at the time of pickup.
1.3 Deposits are non-refundable under any circumstances and are not transferable to another bunny.
1.4 Prices are fixed and non-negotiable, based on the specific characteristics of the bunny (e.g., color, markings, etc.).
1.5 By paying the deposit, the Buyer affirms their understanding and acceptance of all terms in this Agreement, and payment serves as legal acknowledgment and acceptance of these terms.

2. Pickup and Transport
2.1 All bunnies must be picked up at Hawaii Rabbitry’s location on Oahu.
2.2 The Buyer is solely responsible for making transport arrangements before reserving a bunny.
2.3 A boarding fee of $10 per day will apply if the bunny is not picked up on the scheduled pickup date.
2.4 Bunnies will not leave the Seller’s possession until they are at least 8 weeks old.
2.5 If the Buyer does not pick up the bunny on the scheduled date and does not arrange for an alternative pickup, the Seller reserves the right to consider the bunny forfeited, and the deposit will not be refunded. The Seller may re-list the bunny for sale.

3. Shipping to Other Islands (if applicable)
3.1 If necessary, the Seller can arrange to ship bunnies to certain islands. The Buyer must contact the Seller to discuss shipping arrangements. The Buyer is responsible for all shipping fees and ensuring that proper arrangements are made for the safe transport of the bunny.
3.2 The Buyer acknowledges that the Seller’s shipping option is subject to availability and does not guarantee that shipping will be available for all islands.

4. Health, Gender, and Temperament
4.1 The Seller ensures that all bunnies are healthy to the best of their knowledge at the time of pickup.
4.2 The Buyer acknowledges that the Seller cannot guarantee the temperament, behavior, or adult size/weight of the bunny.
4.3 The gender of the bunny is checked multiple times, but the Buyer understands that gender may not be 100% accurate. The Buyer is responsible for verifying gender and health at the time of pickup.
4.4 The Buyer agrees that handling and socialization of the bunny is the Buyer’s responsibility once the bunny leaves the Seller’s possession.

5. Return, Refund, and Replacement Policy
5.1 All sales are final once the bunny leaves the Seller’s possession, and no refunds, exchanges, or replacements will be provided after pickup.
5.2 If the bunny dies in the Seller’s possession before pickup, the Buyer will be offered a full refund or the option to choose a replacement bunny of equal value.
5.3 In the event that the Buyer is unable or unwilling to keep the bunny, the Buyer agrees to inform the Seller immediately. The Seller will accept the return of the bunny; however, no refunds will be provided. The Seller reserves the right to refuse the return of any bunny that has health complications or conditions that may pose a risk to the health and safety of other rabbits at Hawaii Rabbitry. The Buyer is responsible for providing documentation from a licensed veterinarian confirming the bunny's health status if requested by the Seller.
6. Liability and Assumption of Risk
6.1 The Buyer assumes all risks and liabilities related to the bunny after it leaves the Seller’s possession, including but not limited to health, injury, or death of the bunny.
6.2 The Seller is not responsible for any veterinary bills, health issues, or injuries that occur after the bunny is in the Buyer’s care.

7. Miscellaneous Terms
7.1 The Buyer agrees to use the services of a qualified veterinarian for the care of the bunny after purchase.
7.2 This Agreement is governed by the laws of the State of Hawaii.
7.3 Any amendments to this Agreement must be made in writing and agreed upon by both the Buyer and the Seller.
8. Pickup-Only and Shipping Policy
8.1 The Buyer acknowledges and agrees that the Seller operates a pickup-only policy for Oahu residents. The Buyer must make all necessary arrangements to pick up the bunny at Hawaii Rabbitry’s location on Oahu.
8.2 If the Buyer is coming from another island and wishes to arrange for an airport meeting, the Buyer must contact the Seller at least 48 hours in advance. The Buyer will be responsible for all additional gas fees related to the meeting.
8.3 If shipping is required, the Buyer must make arrangements with the Seller, and shipping fees will be the responsibility of the Buyer.

Binding Agreement
By submitting payment of the deposit, the Buyer agrees to all terms and conditions outlined in this Agreement and acknowledges that they are legally bound by its terms. No additional signature is required for this Agreement to be enforceable.
